Brandyberry sentenced on sexual imposition charge

A Bellefontaine man is serving a portion of a 60-day sentence imposed after he changed his plea during an Oct. 27 Bellefontaine Municipal Court trial for misdemeanor sexual imposition.

Zachary K. Brandyberry, 29, changed his plea from not guilty to guilty, according to court records.

Judge Jacob Estes imposed the sentence and suspended 50 days on the condition the defendant successfully completes two years of probation along with a slew of other conditions.

The judge ordered Brandyberry to pay a fine of $350 and court costs. Brandyberry also has to serve 40 hours of community service.

Judge Estes found Brandyberry will have to register as a Tier 1 sex offender each year for 15 years and ordered that he have no contact with non-relative minor children without prior approval of his probation officer.

Brandyberry was accused in June of inappropriately touching a 15-year-old DeGraff girl and kissing her on the lips while visiting at the girl’s home. He also exchanged text messages with the girl.

Detectives with the Logan County Sheriff’s Office investigated the complaint and reported the inappropriate touching was outside the victim’s clothing.

Detectives also did not find evidence of nudity-oriented material involving the victim on the defendant’s phone nor the victim’s phone.

Brandyberry was given one day of jail time credit. He began serving the remaining nine days on Wednesday, Nov. 5.
