Summons issued for open container

Marcus Cobb, 42, of Bellefontaine, was charged with possession of an open container in a public place following investigation of a complaint fielded by officers of the Bellefontaine Police Department shortly before 8 p.m., Wednesday, Oct. 16.

Police were dispatched to the Marathon gas station at 1138 N. Main St. on a report of a possibly intoxicated driver that was driving erratically and reportedly and caused multiple accidents.

Upon arrival, officers made contact with Cobb who showed police that the bed of his truck had fallen down while he was driving and that caused his erratic driving. Police did observe him with an open can of alcohol and Cobb said he’s purchased the beer after stopping at the gas station.

Cobb said he hadn’t been drinking prior to arriving at the gas station and that he’d consumed one beer prior to officers arriving. He had a ride coming to get him because of his truck bed, officers were told. A faint odor of alcohol was detected, but Cobb did not appear impaired and he declined requests for field sobriety tests. A clerk inside the gas station confirmed that Cobb had purchased the beer inside.

He was issued a summons and released from the scene.
