Prosecutor: Ohio officer justified in killing

AKRON, Ohio (AP) — Prosecutors have ruled that a University of Akron police officer was justified in killing a motorist who drew a BB gun during a traffic stop.

An investigative report released Wednesday by the Summit County prosecutor's office said Officer Aaron Burnette acted appropriately when he fatally shot 64-year-old James Genda.

The Akron Beacon Journal (http://bit.ly/12toyPF ) reports that the investigation found Genda did not want to return to jail and forced the officer to shoot by drawing the realistic-looking BB gun. The scenario was supported by a witness who said Genda had planned such a move weeks before the shooting.

Burnette was on patrol when he stopped Genda for driving with improper plates. The officer fired into Genda's car after the Akron man pulled out what appeared to be a .45-caliber pistol.
