Negligence case costs OSU hospital $5.25 million

COLUMBUS, Ohio (AP) — Ohio State University's medical center has settled a negligence lawsuit involving a brain-damaged newborn for more than $5 million.

The Ohio Court of Claims reported the $5.25 million settlement Thursday in the suit against OSU's Wexner Medical Center by a Columbus-area couple over the 2006 birth of their son.

Saynad Muse and Ali Gelle claimed an obstetrician had waited too long to determine whether a cesarean-section delivery was necessary, resulting in a brain injury to the child.

The couple's attorney said the child, now 7 years old, suffered "a profound brain injury" and requires around-the-clock care.

Wexner Medical Center spokesman Robert Mackle told The Columbus Dispatch that the hospital "worked closely with the family to reach what we feel is a fair and just resolution to the case."
