A defendant not yet of legal age to consume alcohol was ordered Monday by Logan County Common Pleas Court Judge Mark S. O’Connor to a residential treatment facility for treatment of his alcoholism.
Ethan Smith, 20, of Russells Point, was sentenced to six months at the West Central Community Based Correctional Facility, five years’ community control and was ordered to pay court costs for one count of felonious assault, a second-degree felony.
The defendant pleaded no contest and was found guilty Dec. 19 of assaulting a victim at a house party in the Indian Lake area.
A June indictment charged two counts of felonious assault.
The charge carries with it a presumption in favor of prison, according to Ohio sentencing guidelines. The judge had to make certain findings to issue a community control sanction. Among them, this charge was Mr. Smith’s first felony conviction and he is unlikely to re-offend. The court also ruled the defendant was provoked because he had reportedly just witnessed his girlfriend being assaulted at the party.
