Appeals judges rule on cases heard locally in October

Judges with the Third District Court of Appeals have reached decisions in two cases heard during a traveling session of the court in October.

Students from Bellefontaine, Benjamin Logan and Riverside high schools observed the oral arguments at the BHS Distance Learning Center and heard attorneys argue a local robbery case and landlord/tenant dispute from Marion.

The judges upheld Douglas Risner’s conviction and sentence for a 2011 robbery of the Varsity Drive-Thru, 1324 S. Main St.

They found Logan County Common Pleas Judge Mark S. O’Connor did not make any errors by allowing certain testimony during the trial, nor was the defendant denied effective counsel.

Judges, however, ordered the case back to the trial court to hold a hearing on court costs and restitution.
